These Terms of Agreement explain how Smart Process LLC provides process serving, document delivery, and related support services. By placing an order, uploading documents, requesting service, making payment, or communicating with Smart Process LLC about a service request, you agree to these terms.

Smart Process LLC is not a law firm and does not provide legal advice. These terms are provided for general service information and do not create an attorney-client relationship.

1. Our Services

Smart Process LLC provides professional process serving and related document delivery services for legal matters, including but not limited to citations, petitions, subpoenas, summons, notices, orders, writs, and other legal documents.

Our services may include routine service, rush service, same-day service, document pickup, document delivery, court-ready proof of service, affidavits or returns of service, and status updates.

Smart Process LLC serves clients who need reliable, legally compliant, and timely handling of legal documents. Service availability may vary based on location, document type, court requirements, recipient availability, safety concerns, and the facts of the assignment.

2. No Legal Advice

Smart Process LLC is not a law firm and does not provide legal advice. We do not represent clients in court, interpret legal documents, determine legal deadlines, choose legal strategies, or advise whether a particular method of service is legally sufficient for your case.

You are responsible for consulting with an attorney, court clerk, or appropriate legal professional if you have questions about your rights, filing requirements, deadlines, service rules, or case strategy.

3. Client Responsibility for Accurate Information

You agree to provide complete and accurate information for each service request. This includes the correct name of the person or entity to be served, physical address, apartment or suite number, business name, phone number if available, known schedule, identifying details, safety concerns, court information, case number, and any special instructions.

Smart Process LLC is not responsible for delays, failed attempts, additional fees, or legal consequences caused by incomplete, inaccurate, outdated, or misleading information provided by the client.

4. Document Submission

Documents may be submitted electronically, uploaded through the website, emailed, or provided by another approved method. You are responsible for making sure all documents are complete, legible, properly issued, and ready for service.

Smart Process LLC may refuse or delay service if documents appear incomplete, unreadable, improperly formatted, missing required pages, or otherwise unsuitable for service. We may request corrected documents before beginning or continuing service.

5. Service Attempts

A service attempt means a physical or authorized effort to serve the documents at the address or location provided. All service packages — Routine, Rush, and Same-Day Rush — include up to 4 service attempts within 10 business days of the order being accepted.

Attempts may be made at reasonable times based on the assignment, location, safety, and likelihood of successful service. Rush and same-day services are prioritized, but successful service is not guaranteed.

If all 4 included attempts are unsuccessful and the client requests an additional attempt, it will be made available at 50% of the original service fee. Smart Process LLC will contact the client before any additional charges are applied.

If the recipient is avoiding service, has moved, cannot be located, or is not available after all included attempts, Smart Process LLC may provide an affidavit or declaration of due diligence when appropriate and requested.

6. Rush and Same-Day Service

Rush and same-day service requests are handled with priority. Same-day service is subject to availability, time of submission, document readiness, location, distance, traffic, court requirements, and server availability.

Same-day service does not guarantee that the person will be served the same day. It means Smart Process LLC will prioritize the assignment and make a timely attempt when the request is accepted and feasible.

Orders submitted after the daily cutoff time may be treated as next-business-day requests unless otherwise confirmed in writing.

7. Proof of Service, Return of Service, and Affidavits

After service is completed, Smart Process LLC will prepare the appropriate proof, affidavit, or return of service based on the information available and the applicable requirements.

The proof of service may include details such as the case name, court, case number, documents served, date and time received, person or entity served, address served, date and time of service or attempted service, method of delivery, and process server information.

The client is responsible for reviewing the proof of service and notifying Smart Process LLC promptly if corrections are needed. Smart Process LLC is not responsible for court rejection caused by client-provided errors, missing court information, incorrect documents, or filing requirements outside our control.

If the client requires an affidavit, return of service, or proof of service to be notarized, the cost of notarization shall be borne by the client. Notarization fees may be charged in addition to the standard service fee unless notarization is expressly included in the selected service package or confirmed in writing by Smart Process LLC.

8. Filing with the Court

Unless filing is expressly included in the selected service package or confirmed in writing, Smart Process LLC is responsible for completing the service and providing the proof of service to the client. The client is responsible for filing the proof of service with the court.

If Smart Process LLC agrees to file a return or proof of service, the client remains responsible for confirming court acceptance, deadlines, and case-specific requirements.

9. Fees and Payment

Payment may be required before service begins. Fees are based on service type, urgency, location, number of recipients, number of addresses, number of attempts, document volume, travel distance, special handling, and any additional requested services.

Additional charges may apply for incorrect addresses, multiple addresses, additional attempts, wait time, printing, notarization, court filing, mileage, skip tracing, or service outside the standard coverage area.

Smart Process LLC may pause or decline service if payment has not been received.

10. Refunds

Because process serving requires time, travel, preparation, and attempted work, fees are generally non-refundable once work has begun.

A refund may be considered if an order is canceled before any work, preparation, printing, travel, or service attempt has occurred. Rush, same-day, special handling, and completed attempt fees are generally non-refundable.

A successful serve is not guaranteed. Payment is for professional effort, proper handling, documented attempts, communication, and completion of the requested service process.

11. Cancellations

You may request cancellation by contacting Smart Process LLC as soon as possible. If cancellation is received before work begins, a refund or partial refund may be available.

If documents have already been reviewed, printed, assigned, dispatched, or attempted, the order may be partially or fully non-refundable.

12. Turnaround Times

Estimated turnaround times are not guarantees. Service depends on recipient availability, address accuracy, weather, traffic, building access, security restrictions, court requirements, safety conditions, and other factors outside our control.

Smart Process LLC will make reasonable efforts to complete service promptly and communicate updates when available.

13. Communication and Status Updates

Smart Process LLC aims to provide clear communication throughout the service process. Updates may be provided by email, phone, text message, online form, or other agreed method.

Clients are responsible for monitoring messages and responding promptly to requests for additional information, corrected documents, address updates, or approval for additional attempts.

14. Safety and Refusal of Service

Smart Process LLC reserves the right to refuse, pause, or cancel any service request that appears unsafe, unlawful, misleading, abusive, harassing, outside our service scope, or inconsistent with applicable rules.

We may also refuse service if the client asks us to misrepresent facts, trespass, threaten, impersonate law enforcement, violate court rules, or engage in improper conduct.

15. No Guarantee of Outcome

Smart Process LLC does not guarantee that a person will be located, served, or that a court will accept a filing, grant a motion, issue a judgment, or rule in the client's favor.

Our role is limited to professional service attempts, document handling, reporting, and preparation of appropriate service documentation.

16. Client Authorization

By submitting a service request, you confirm that you are authorized to request service of the documents provided. You also confirm that the documents are intended for lawful service and that the information you provide is accurate to the best of your knowledge.

17. Confidentiality

Smart Process LLC treats client information, case details, addresses, and legal documents with care and confidentiality. Information may be shared only as needed to perform the requested service, prepare proof of service, communicate with the client, comply with court requirements, or as required by law.

18. Limitation of Liability

To the fullest extent permitted by law, Smart Process LLC is not liable for indirect, incidental, consequential, special, punitive, or attorney-fee damages arising from a service request.

Smart Process LLC is not responsible for missed deadlines, court rejection, incorrect filings, case outcomes, or legal consequences caused by inaccurate information, late submission, incomplete documents, client delay, court rules, third-party conduct, or circumstances beyond our control.

19. Indemnification

You agree to hold Smart Process LLC harmless from claims, costs, damages, losses, or expenses arising from inaccurate information, improper documents, unauthorized requests, unlawful instructions, or misuse of our services.

20. Changes to These Terms

Smart Process LLC may update these Terms of Agreement at any time. Updated terms will be posted on the website with a revised effective date. Continued use of our services after updates means you accept the revised terms.
